Party Wall Issues

If you intend to carry out construction or alterations which involve:

  • Work on a wall, floor or ceiling shared with another property
  • Building on the boundary with another property
  • Excavating within 6 metres of an adjoining building

You may find that the work falls within the scope of this Act.

If it does, you must serve statutory Notices on all those defined by the Act as adjoining owners. This is quite separate from any need for planning permission and/or building regulation approval.

The Act provides a fair solution to the problems that are frequently encountered when building on or adjacent boundaries or in confined areas.

The surveyors will prepare an "Award" which records the condition of the neighbouring property before the work begins, deals with arrangements for access, sets out the work to be carried out and the way in which it should be carried out.

The owner who first planned the work will usually be responsible for costs associated with the Award but the surveyor may decide that they should be apportioned where there are benefits to other parties.
